House Bill 1267, introduced in January of 2002, would require all state and local law enforcement officers to collect race, age, gender of the driver and other information for each traffic stop after June 30, 2003. Beginning March 1, 2005, each agency would be responsible for compiling the data collected from the previous year into a report to be given to the State Attorney General. The Attorney General will then analyze the data and prepare a report for the governor, the executive director of the legislative services agency and for each individual agency. The data is for research purposes only and will not contain information identifying the driver stopped or the law enforcement officer who initiated the stop. Each agency must also adopt a policy against racial profiling and must conduct investigations if the Attorney General’s report reveals a pattern of racial profiling. Officers found to be engaging in racial profiling will undergo counseling and sensitivity training. Civilian Review Boards will be established to handle citizen complaints and will submit its findings to the head of each law enforcement agency. At least one jurisdiction is also collecting data because of a court settlement.

Other Information: Requires the compilation of data concerning traffic stops, including the race of a driver stopped by a law enforcement officer. Provides that the data may not be used in a legal proceeding to establish an inference of discrimination. Requires a law enforcement agency to prohibit racial profiling and to provide sensitivity training. Authorizes the establishment of local civilian review boards to investigate allegations of misconduct by law enforcement officers.
