Rhode Island’s "Traffic Stops Statistics Act" was enacted July 13, 2000 and became effective upon passage. The Act requires all state and local police departments to collect data for all traffic stops. The Final Report for the study related to the Traffic Stop Statistics Act was released in January 2004. In February and March 2004, members of the Senate and House introduced companion bills to be called the "End Racial Profiling Act of 2004" that would follow-up on the previous act by banning racial profiling and continuing to require data collection.

Scope of Collection: vehicle stops
Data Collected: age, race, gender, ethnicity, reason for stop / alleged violation, date, time, location, license plate number, warning given, citation given, arrest made, personal search conducted, search of vehicle conducted, contraband found, items seized for forfeiture, authority for search
Other Information: This is a February 2004 companion bill to H. 8221 that responds to the Rhode Island Traffic Stop Statistics Act Final Report released in January 2004. The act would place a ban on racial profiling in traffic stops by state and municipal law enforcement agencies to report and would set up a system requiring law enforcement agencies to collect data and complete regular reports of findings and statistics regarding traffic stops. In May 2004, the Senate Judiciary Committee recommended the bill be held for further study.

Restrictions: data on drivers only -- nothing collected on passengers
Data Collection Dates: January 01, 2001 through December 31, 2002
Data Collected: age, race, gender, ethnicity, reason for stop / alleged violation, date, time, location, license plate number, warning given, citation given, arrest made, personal search conducted, search of vehicle conducted, contraband found, items seized for forfeiture, authority for search
Other Information: Police agencies must submit their data monthly to the Attorney General. The Attorney General must prepare quarterly summary reports which are available for the public record. After 2 years the Attorney General must complete a comprehensive report which is submitted to the Governor and General Assembly. Attorney General and an advisory committee will appoint an organization to assist with the design of the methodology, monitor compliance, and conduct statistical analysis at the end of the study (Northeastern's Center for Criminal Justice Policy Research). The legislation also includes formation of a Traffic Stops Advisory Committee to assist Attorney General, and the Attorney General and/or any organization committed to combatting discrimination or civil liberties may sue any police department for failing to comply with the act.
