WEST VIRGINIA
On March 7, 2002, West Virginia enacted a bill that prohibits law enforcement officers from using race, ethnicity, or national origin in selecting who will be subject to traffic stops, stops and frisks, questioning or searches. The statute also requires state and local law enforcement agencies to develop and maintain procedures for receiving, investigating and responding to complaints of racial profiling. It does not mandate data collection. A West Virginia State Police policy, however, requires that state police officers record race data about motorists who are issued citations, are arrested, or if the officer uses force against the motorist. The agency is considering expanding this policy to all traffic stops.
